Wisconsin: online casino, sweepstakes and sports betting law

Wisconsin's gambling chapter, 945, treats betting as a misdemeanor and leaves no room for online casino games. Since 9 April 2026, when 2025 Wisconsin Act 247 was enacted, mobile sports bets handled on tribal servers fall outside the definition of a bet, though we have not confirmed a live app. We could find no ban on sweepstakes casinos in Chapter 945.

Real-money online casino

Not legal

Not legal. Placing a bet or running a lottery is a Class B misdemeanor under Wis. Stat. 945.02, and the definitions in 945.01 make no exception for casino games played online. The carve-outs that exist are the state lottery (ch. 565), raffles and bingo, pari-mutuel racing, and mobile sports bets on tribal servers.

Sweepstakes casinos

No ban found

We found no law that bans online sweepstakes casinos in Chapter 945 of the Wisconsin Statutes. Under 945.01(5), a lottery requires paying something for a chance at a prize (checked 19 Oct 2026).

Online sports betting

Legal, not live yet

Legal but not live. Since 9 Apr 2026, 2025 Wisconsin Act 247 has said a mobile sports bet is not a bet under state law when the server sits on tribal land and the tribe's compact was first signed before April 1993. We have not confirmed that any mobile sportsbook is live.
