Massachusetts: online casino, sweepstakes and sports betting law

DraftKings has taken online sports bets in Massachusetts under a state license since March 2023, according to the Gaming Commission. Casino games are only legal inside licensed gaming establishments, and we found no law that allows them online. On sweepstakes, the one relevant rule, G.L. c. 271 s. 5B, deals with sweepstakes machines. Nothing we could find in state law targets online sweepstakes casinos.

Real-money online casino

Not legal

Not legal. Under G.L. c. 271 s. 1, a person who wins money by gaming or betting forfeits double the amount unless chapter 23K (licensed gaming establishments) or chapter 23N (sports wagering) allows the play. Section 7 punishes lotteries and games of chance held outside a casino licensed under 23K with up to three years in state prison. We found no law that permits online casinos.

Sweepstakes casinos

No ban found

No ban found as of 19 Oct 2026. Under G.L. c. 271 s. 5B, it is illegal to possess electronic machines that run sweepstakes behind a game-style display. That rule is about physical terminals, not online sweepstakes casinos.
