New York: online casino, sweepstakes and sports betting law
In New York you can bet on sports from your phone with one of nine licensed operators, but online casino games remain illegal. The state shut out dual-currency sweepstakes casinos in December 2025 with a law that also covers the payment processors and media affiliates that support them. Penalties under that law reach $100,000 per violation.

Real-money online casino
Not legal
Not legal. New York Penal Law 225.00 treats gambling as unlawful unless a law specifically allows it. Under 225.05, knowingly helping run or profiting from unlawful gambling is a class A misdemeanor called promoting gambling in the second degree. The Gaming Commission treats mobile sports wagering as authorized, but we found no statute that does the same for online casino games.

Sweepstakes casinos
Banned
Banned. S5935-A became Chapter 605 when it was signed on 5 Dec 2025, and it took effect that day. It outlaws online sweepstakes games built on two currencies that can be cashed in, and bars payment processors, platform providers, content suppliers and media affiliates from supporting them. Each violation carries a fine between $10,000 and $100,000, and offenders can lose a gaming license or be barred from getting one.
